My husband passed away on 13th May 2006
He was petitioner for son - aged out case- and was about to challenge in court- As husband died, the case died, so I will have to start an immigration petition again (I thinK) and as service centre is working on cases received in 1998 - it will be 7-10 years as now over 21 years and need a visa number to be available
As son was waiting 5 years for green card, has been coming to the US on a visa waiver
He normally visits once per year for approx 75-80 days and never overstayed
As father was ill he came back to US from 16 Mar- 4th June. Father died in May
Congressman said he must not overstay (which we knew) go back to home country and apply for B visa
Son went to American Embassy, had proof of my medical condtion saying my son was needed to help me get probate, give each other and his brothers emotional support and to find a final resting place for fathers remains now that the cremation has taken place.
He also took proof that he pays all utility bills on family home. Proof he was director of Company in UK and the company owned property.
The officer was so cold, he did not even say sorry for your loss. He said you do not have enough strong social, financial, family ties etc., and do not bother re-applying unless circumstances change dramatically
As all immeadiate family members already live in USA, he will never be able to prove this
Any ideas?
